Squawk — Terms of Service

Squawk is operated by Jamison Tech LLC (“Jamison Tech,” “we,” “us,” or “our”), an Iowa limited liability company. These Terms of Service (“Terms”) govern your access to and use of the Squawk mobile application and any related services (together, the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Please also read our Privacy Policy, which explains what data we hold and — more importantly for Squawk — what we deliberately cannot hold.


1. What Squawk Is

Squawk is an ephemeral, intent-driven proximity radar. You tell the app you are in a city or at a venue (“dropping a beacon”), and the trusted contacts you have connected with can see that you are around, so spontaneous meetups can happen.

Squawk is not a continuous location tracker. It does not follow you in the background, it does not build a location history, and it does not broadcast to anyone except contacts you have explicitly and mutually connected with.

How the Service is built matters to these Terms. Squawk is end-to-end encrypted. Your location, your profile, your notes, and your contact list are encrypted on your device before they ever reach our servers. Our servers act as a blind relay: they pass along sealed messages they cannot open. This design has consequences that are spelled out in Sections 5, 6, and 9 below — in particular, there are things we cannot do for you, because we built the system so that we cannot do them to you either.


2. Eligibility and Age

  • You must be at least 16 years old to use Squawk. The Service is not directed to children under 16, and we do not knowingly permit them to create accounts.
  • If you are between 16 and the age of majority where you live, you may use Squawk only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.
  • If we learn that an account belongs to someone under 16, we will delete it.
  • Some jurisdictions set a higher minimum age for consent to data processing. Where local law requires a higher age than 16, that higher age applies to you.

3. Your Account

  • You create an account with an email address. We send a one-time code to that address to confirm you control it. There is no password.
  • You are responsible for maintaining access to your email account and for activity that occurs under your Squawk account.
  • One active device at a time. Signing in on a new device signs out the previous one. This is a deliberate security property, not a limitation to be worked around.
  • You agree to provide accurate information and to keep your account email current.

4. Trusted Contacts, and What Other People Can See

Connections in Squawk are established out of band — by scanning someone’s QR code in person, or by sending them your invite link through a messaging app you already use. Our servers never carry the keys that establish trust.

You should understand the following before you use the Service:

  • Your invite link and QR code identify your account. Share them only with people you are willing to have add you. Anyone who receives your invite can add you, and adding you means they will begin receiving your beacons.
  • Trust must be mutual before anything becomes visible. Adding someone begins sending your presence to them, but nothing is readable by either of you until you have both added each other. Until trust is mutual, what you send sits sealed and unopenable on their device. Once you have both added each other, you can each see the other. The app labels this state while it is pending.
  • Beacons are snapshots, and they expire. A venue beacon lasts up to 18 hours. A city beacon lasts up to 72 hours on the free tier and up to 30 days for Pro subscribers, who can additionally set a city as “indefinite” — maintained on a rolling 90-day horizon and requiring continued use of the app, so a device that goes unused for 90 days stops broadcasting. Nothing is permanent.
  • Removing a contact is the block mechanism. Removing someone stops your beacons reaching them and removes them from your device. Because the system is end-to-end encrypted and messages already delivered are on their device, removal is not retroactive — it stops future sharing, it cannot un-send the past.

You are responsible for deciding who you trust. We cannot see your contact list, so we cannot vet it, moderate it, or intervene in it.


5. Your Content and Your Conduct

Squawk lets you share a small amount of user-generated content with your trusted contacts: your display name, an optional photo, an optional phone number, and short context notes attached to your beacons.

You are solely responsible for the content you share. Because that content is end-to-end encrypted, we cannot read it, cannot pre-screen it, and cannot moderate it. Our enforcement tools are limited to account-level action, and depend on someone reporting a problem to us.

You agree not to use Squawk to:

  • Harass, stalk, threaten, defame, or intimidate any person.
  • Share content that is obscene, sexually exploitative, or that sexualizes minors.
  • Impersonate any person or misrepresent your affiliation with anyone.
  • Share another person’s private information without their consent.
  • Attempt to determine another person’s location without their knowledge or against their wishes.
  • Violate any applicable law.
  • Interfere with, overload, probe, or attempt to circumvent the Service, its rate limits, its encryption, or its abuse protections.
  • Automate access to the Service, or build a competing service using access obtained through it.
  • Knowingly make a false report about another user. Because we cannot read your content, we necessarily rely on what reporters tell us. Deliberately misusing that trust — especially a false report of child sexual content, which we act on immediately — is itself a serious violation of these Terms.

Reporting. If someone is misusing Squawk, report it through Settings → Help → Send feedback in the app, or email squawk@jamisontech.com. Reports reach us directly. To stop someone reaching you immediately, remove them as a contact — that takes effect without waiting for us.

What a report tells us. When you report someone from within the app, we receive the account identifier your device holds for them, the categories you tick, the name you type for them, and what you write. We do not receive their photo, their display name as stored on your device, your nickname for them, their location, their beacons, or their notes — we cannot read any of that, and reporting does not change it. Everything we learn about the person you are reporting comes from what you choose to write.

False reports. We keep a record of who reported whom. We cannot determine whether any single report is true — we cannot see the content it describes — but a pattern of reports from one person against several different people, or a report filed immediately after that person was removed as a contact, is visible to us and may result in the reporter’s account being suspended.

Enforcement. We may suspend or terminate an account that violates these Terms. Given the encrypted design, our practical remedy is account termination rather than content removal, and we act on reports rather than on surveillance. A suspension is normally reversible: your data stays on your device, and lifting a suspension restores your account as it was.


6. Your PIN, Your Backup, and the Limits of Our Help

When you set up Squawk you choose a PIN. That PIN encrypts a backup of your identity key, your contact list, and your profile, which we store as ciphertext we cannot read.

This is the most important paragraph in these Terms:

If you forget your PIN, we cannot recover your data. Not “will not” — cannot. We do not hold your PIN, and we do not hold any key that opens your backup. There is no reset link, no support override, and no administrative recovery path. If you lose your PIN, you lose your contact list and must start over.

This is the direct cost of a design in which nobody — including us, including anyone who compromises us, and including anyone who serves us legal process — can read your data. We think the trade is worth it. You should decide whether you agree before you rely on the Service.

Choose a PIN you will remember. The app asks you to confirm it at setup for exactly this reason.


7. Free and Paid Features

Squawk offers a free tier. Additional features — including indefinite city anchors, ghost mode, and an expanded radar radius — are offered as part of a paid “Pro” tier.

  • Any paid subscription is sold and billed through the Apple App Store or Google Play, and the applicable store’s terms govern payment, renewal, cancellation, and refunds. We do not process your payment card and never see your payment details.
  • Subscriptions renew automatically unless canceled through your store account.
  • We may change which features are free and which are paid. If a change materially reduces what you have already paid for, we will tell you in advance.
  • We may grant free or discounted Pro access as a promotion, and we will describe its terms at the time. If we later raise the price, anyone already subscribed keeps the price they signed up at for as long as their subscription stays active — that is handled by the app store, not by us.

8. Third-Party Services

Squawk uses a small number of third-party services to function. When you use certain features, data goes to those providers:

  • Google Maps Platform — when you open the map picker, search for a venue, or let the app name your city, your device’s location and your search terms are sent to Google. This happens outside Squawk’s encryption boundary and is governed by Google’s own terms and privacy policy.
  • Apple Push Notification service and Firebase Cloud Messaging — used to wake your device. The wake-up signal contains no content.
  • Google Workspace — used to deliver account emails.
  • Cloudflare — routes traffic to our servers.

Our Privacy Policy describes what each provider receives. We are not responsible for third-party services, and your use of them is subject to their terms.


9. Availability, and Disclaimer of Warranties

Squawk is an independent product built by a small company. We may change, suspend, or discontinue any part of the Service, and we may impose limits to protect the Service and its users.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAMISON TECH LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY BEACON, MESSAGE, OR NOTIFICATION WILL BE DELIVERED.

Do not rely on Squawk for safety-critical or emergency purposes. It is a social convenience tool. Beacon delivery depends on networks, push providers, and device state outside our control. Never use it as your only means of reaching someone in an emergency.


10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JAMISON TECH LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) TWENTY-FIVE US DOLLARS ($25).

WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR LOSS OF DATA RESULTING FROM A FORGOTTEN PIN (SECTION 6), OR FOR THE ACTS OR OMISSIONS OF YOUR TRUSTED CONTACTS.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, our liability is limited to the smallest extent permitted by law, and nothing in these Terms limits liability that cannot lawfully be limited.


11. Indemnification

You agree to defend, indemnify, and hold harmless Jamison Tech LLC and its members, officers, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your misuse of the Service, or content you shared through the Service.


12. Intellectual Property

The Squawk name, logo, application, and underlying software are the property of Jamison Tech LLC or its licensors, and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose.

You may not copy, modify, reverse-engineer, decompile, resell, or create derivative works from the Service, except to the extent that applicable law expressly permits it notwithstanding this restriction.

Your content remains yours. We claim no ownership of your profile, your notes, or your contact list — and, by design, no ability to read them.


13. Termination

  • You may terminate at any time. Use Burn in the app (Settings → Manage account → Danger zone). Burn deletes your account and its server-side records, and wipes Squawk’s data from your device. It is immediate and irreversible.
  • We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if we discontinue the Service.
  • Sections 5, 6, 9, 10, 11, 12, 14, and 15 survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Iowa, without regard to its conflict of laws principles. Any suit, action, or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Polk County, Iowa, and you consent to the jurisdiction and venue of those courts.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings in your local courts or to the protection of mandatory local consumer law, nothing in this Section removes those rights.


15. Changes to These Terms

We may update these Terms. When we do, we will update the “Last Updated” date and post the current version. If a change is material, we will give you notice in the app or by email before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
